What happens if the funding company does not comply with the rules?

If an Issuer commits violations of the rules, Walliance has the right to terminate the existing contractual relationship until the Offer is finalized by notifying the Issuer. Violations may relate to one or more of the following obligations under the Issuers' General Terms and Conditions:

  • of Article 3, it being understood in that case that if Walliance has a well-founded suspicion of such a violation, it may suspend the possibility for Users to subscribe to the Offer in order to protect them;

  • failure to carry out in a timely manner the formalities set forth in Article 8.3 and/or failure to notify Walliance in accordance with the provisions of the same article;

  • violation of Article 11.3.

In the event that Walliance declares its intention to terminate the relationship at a time following the publication of the Offer on the Portal, but prior to the closing date of the Offer, the Offer will be unsuccessfully closed and any funds paid by Investors will be returned to Investors, who will also be informed of the failure of the campaign.
