Walliance SIM SpA adheres to the Arbitration for Financial Disputes (ACF).

The out-of-court dispute resolution system is characterized by the decisive nature of the procedure, and aims to provide an effective means of protecting investors' interests. Access to the Arbitration is free of charge for the investor, and there are short deadlines for reaching a decision (90 days from the completion of the file).

Application scope

ACF decides on disputes relating to the violation of the obligations of information, diligence, fairness and transparency to which intermediaries are bound in their dealings with investors in the provision of investment services (e.g., provision of advisory service, placement service or receiving and transmitting orders) up to a requested amount of 500,000 euros.

Procedures

Before appealing to the Arbitrator, you must file a complaint with Walliance by following the appropriate procedure at the link: https://help.walliance.eu/en/articles/8576242.

Only if no response is received after 60 days from the submission of the complaint, or if the response obtained is not deemed satisfactory, it is possible to appeal directly to the Arbitrator through the appropriate form made available on the ACF website: www.acf.consob.it.

The appeal can be submitted online, on the ACF website. It is necessary to register and access the restricted area with the given credentials. Appeal can be submitted by entering requested information following the procedure.

It should be noted that the right to appeal to the Arbitrator cannot be waived by the investor. It can always be exercised, even in the case of clauses for the devolution of disputes to other out-of-court settlement bodies contained in contracts.

Walliance ensures that complaints received are evaluated considering also guidelines deduced from ACF decisions. If such complaints are not upheld, even partially, the investor is provided with adequate information about the ways and timescales for filing an appeal with the Arbitrator.
